Mayor & City Council <br />November 20, 1998 <br />Page 2 <br />could make good long -term sense given we will ultimately need this site to further our <br />redevelopment objectives. The problem with this approach is that based on the <br />information we have to -date, this is highly speculative. Without this right -of -way, we <br />would need to postpone the project for at least another year. Further discussion and/or <br />direction from the City Council is necessary on this matter. <br />♦ Another significant issue regarding the turn-back of Little Canada Road is whether the <br />County will warrant the existing right -of -way as part of the turn-back. As you may <br />recall, they are counting on prescriptive use to define the southerly edge of the roadway <br />in the area of Round Lake. We have stated to their representatives in the past that the <br />City does not want to have a road turned back to us that could generate title concerns in <br />the future. The Council may want to reconfirm this position and/or have the City <br />Attorney pursue this matter with the County Attorney. <br />♦ Rusty Fifield has conducted a financial analysis of Chris Moarn's proposed project. We <br />are refining that analysis and have been attempting to meet with Chris for the past week. <br />I just received a call today from his brother and discovered that Chris is in the hospital. <br />His brother is going to meet with us on Tuesday in an attempt to keep the project moving <br />forward. <br />♦ I have had no further reports from Bob Grootwassink regarding his proposal with <br />Cinemark. I will contact him again prior to Wednesday's meeting. <br />♦ I have informed Sherman Rutzick of the Council's position that construction of a senior <br />apartment building on his property is premature at this point. He would like further <br />clarification as to whether or not any portion of his property could be used for this <br />purpose. He also indicated that he is considering some commercial development with <br />this concept. We will attempt to meet next week and get a better handle on his ideas. <br />This concludes my update.
