515 Little Canada Road, Little Canada, MN 55117 -1600
(651) 484 -2177 / FAX: (651) 484 -4538
MEMORANDUM
TO: Mayor Fahey and Members of the City Council
FROM: Kathy Glanzer, Deputy Clerk
DATE: November 6, 1998
RE: Personnel Policy Changes
MAYOR
Michael I. Fahey
COUNCIL
Beverly Scalze
Jim LaValle
Steve Morel=
Bob Pedersen
ADMINISTRATOR
Joel R Hanson
As directed by the Council at its last meeting, the City Attorney reviewed the Personnel
Policy changes recommended by City staff, and concurred with that recommendation.
The issue is that State Statutes require the payment of overtime after 48 hours worked,
while Federal Statutes require payment after 40 hours. Cities are held to the standard that
is more beneficial to the employee, that is the Federal standard. Therefore, the City's
Personnel Policy is currently in violation with Fair Labor Standards, and should be
amended.
The Attorney will be available at Tuesday's meeting to answer any questions you might
have.
Page 7
