MINUTES <br />PLANNING COMMISSION <br />OCTOBER 8, 1998 <br />Montour stated that he did not want to restrict a new business to placing its <br />sign on the Bally pylon. Montour felt that this sort of restriction would <br />result in a business not locating on that site. <br />Mr. Carson recommended approval of the Conditional Use Permit for a <br />Planned Unit Development for the Schroeder property and allowing the <br />construction of the Bally sign as requested on Outlot A with the square <br />footage of the Bally sign being applied to the maximum signage allowed <br />for Outlot A. <br />Motion seconded by Barraclough. <br />Motion carried 3 — 1. Mr. DeLonais voted against. <br />At this point in the meeting, Mr. Barraclough had to leave. <br />CLARIFY The City Planner reviewed the ordinance as it addresses the measurement <br />SETBACK from the property line to a structure in determining setback. The Planner <br />CALCULATION pointed out that the ordinance states that this measurement occurs at the <br />ground level. This raises concern since a second story of a house could be <br />cantilevered, resulting in that second story encroaching into the setback. <br />While most cantilevered structures extend only two or three feet, the <br />Building Official has indicated that some could extend as much as five <br />feet. <br />The Planner also reviewed the list of structures which the ordinance <br />allows to extend into the setback. These include cornices, eves, gutters, <br />steps, vestibules, etc. <br />The Planning Commission discussed this matter, and it was their <br />consensus that up to a two foot cantilever would be acceptable, but felt <br />that the ordinance should be amended to restrict anything greater. <br />Mr. Carson requested that the City Planner prepare a proposal which <br />would limit the distance a cantilevered structure could extend into the <br />required setback and bring this proposal back to the Planning Commission <br />for consideration at its November meeting. <br />Motion seconded by Montour. <br />Motion carried 3 — 0. <br />Page 12 <br />
