These two lots are located on the south side of
Sunset Court, just west of Edgerton Street. The two lots are currently undeveloped. The
drainage and utility easement in question is five feet on either side of the common lot line,
between Lots 1 and 2. This lot line is currently wooded and rolling terrain. To the best of our
knowledge, there are no utilities placed within this easement.
If these two lots are to be combined into one parcel, we see no problem with the vacation of the
five -foot easement along each side of the common lot line. It does appear that there is a fire
hydrant and other utility facilities located at the common lot corner of Lots 1 and 2 with Sunset
Court. Care should be taken in laying out the home site on the newly combined lots, to have the
driveway avoid this point, so that these facilities do not need to be relocated.
If you have any questions regarding this issue, or would like any additional information, please
call.
Sincerely,
Howard R.
