CITY OF LITTLE CANADA <br />RESOLUTION FOR VACATING UTILITY AND DRAINAGE EASEMENT <br />WHEREAS, <br />The City Council ofLittle Canada has determined to vacate the following described utility and <br />drainage easement: <br />Those utility and drainage easements which lie along and 5 feet on either side (as <br />measured at right angles) of that portion of the common lot line dividing Lots 1 and 2, <br />Block 1, Fredericicshaven Second Addition described as follows: <br />Commencing at a point 10 feet easterly of the southwest corner of Lot 1, as measured <br />along the South line of said Lot 1, thence easterly along said South line to a point which <br />is 10 feet westerly of the Southeast corner of said lot and there terminating. <br />AND WHEREAS, <br />A public hearing was held on September 23, 1998 before the City Council in the City <br />Center after due published and posted notice had been given by the City Administrator on <br />September 8 and 15, 1998, a reasonable attempt was made to give personal notice <br />to all affected property owners, and all persons interested were given an opportunity to be <br />heard; <br />AND WHEREAS, <br />Any person, corporation or city owning or controlling easements contained upon the property <br />vacated, reserves the right to continue maintaining the same or to enter upon such way or portion <br />thereof vacated to maintain, repair, replace, remove or otherwise attend thereto; <br />Page 4 <br />
