subject property. Said plan must be reviewed and approved by the City's <br />Planner. <br />k. Developer shall replace all dead and /or damaged landscaping <br />material and adequately seed boulevard areas between north property line <br />and County Road D within Heritage Office Park 2nd Addition and warrant same <br />as provided for in Provision #17 to follow. Work shall be completed by <br />September 30, 1998. <br />1. Developer shall raise existing fire hydrant along County <br />Road D in manner prescribed by City's Director of Public Works to allow for <br />proper access in all seasons. Developer shall also install handicap <br />designated parking space signage and stripe the existing parking lot <br />pursuant to appropriate codes. Both items shall be completed by October <br />3Q, 1998. <br />m. Any municipal deferred assessments levied against parcels <br />contained within this plat shall be paid in full with accrued interest by <br />December 31, 1998. <br />15. Letter of Credit. The Developer shall furnish the City with an <br />Irrevocable Letter of Credit from an approved lending institution in the <br />amount of Twenty Thousand and No /100 Dollars ($20,000.00) prior to the <br />commencement of construction of improvements to guarantee their completion. <br />Said Letter of Credit shall be immediately available for the City's use to <br />complete part or all of the construction in a timely and satisfactory <br />manner, as determined by the sole discretion of the City. It shall remain <br />in full force and effect until completion and acceptance of the project <br />based on the sole determination of the City. It may be reduced to Five <br />Thousand and No /100 Dollars ($5,000.00) upon completion of all work except <br />landscaping and approval of same by City. The Letter of Credit shall be <br />released in its entirety once all grading and landscaping is complete <br />pursuant to approved plans and receipt of a twenty -four (24) month warranty <br />Page 28 <br />
