within 30 days after completion of bituminous surfaces and landscaping; <br />whichever is earlier. All cost incurred with regard to monument placement, <br />verification and replacement shall be borne by the Developer. <br />d. Entrance signage for the development shall be in accordance <br />with City ordinance requirements. Verification of same shall be made by <br />the City's Planner. <br />e. Developer shall prepare by -laws, covenants, and restrictions <br />to govern all of the Heritage Office Park 3rd Addition plat. Specific <br />provisions to be addressed in these documents include adequate maintenance <br />of association improvements, guarantees of access for emergency vehicles, <br />and permission for the City and any of its contracted service providers to <br />enter the property to accommodate the turn - around of vehicles and <br />equipment. Said covenants and restrictions are to be approved by the City. <br />f. Developer, or its agents or assigns, shall promptly clear <br />from public streets and property any soil, earth or debris resulting from <br />construction work done by the Developer or its agents or assigns <br />respectively. Failure to do so within 24 hours verbal notice by the City <br />will result in the City undertaking this work with costs subject to <br />reimbursement by the Developer pursuant to Paragraph #11. <br />g. Future occupants of the plat shall not be deemed to be <br />third -party beneficiaries of this Agreement. <br />h. Developer shall construct berm and parking lot in such a <br />manner as to allow fire trucks to access the rear of proposed buildings. <br />Final plans shall be approved by the City's Fire Marshal. <br />i. Developer shall apply stucco to the exterior of the existing <br />garage that is proposed to remain in a manner consistent with the exteriors <br />of the other principal buildings contained within this development. <br />j. Developer shall submit a landscape plan providing for <br />additional coniferous planting material along the east property line of <br />Page 27 <br />
