As an "at will" employee, Schroeder understands and agrees that neither this document, any <br />policy of the City of Little Canada, nor any representation made by the City to him shall be <br />construed to constitute a contract of employment or a modification to his "at will" <br />employment. <br />Schroeder understands and agrees that his position as a department head is specifically <br />excluded from the City's Personnel Policy and that the provisions contained in said <br />Personnel Policy have no application to his employment, except as stated herein. All rights <br />governing his employment relationship with the City are set forth in this Agreement. <br />15. OTHER PROVISIONS TO APPLY. Schroeder shall be subject to Section 15 of the City's <br />Personnel Policy entitled "Other Information" during his tenure with the City. Schroeder <br />acknowledges receipt of this section as well as any other sections of the Personnel Policy <br />previously referenced in this Agreement. <br />16. SEVERABILITY. If any provision, or any portion thereof, contained in this Agreement is <br />held to be unconstitutional, invalid or unenforceable, the remainder of the Agreement, or <br />portions thereof, shall be deemed severable, shall not be affected, and shall remain in full <br />force and effect. <br />This Agreement shall become effective Wednesday, September 9, 1998. <br />IN WITNESS WHEREOF, the City of Little Canada, by unanimous vote of its Council, has <br />caused this Agreement to be signed and executed on its behalf by its Mayor and City <br />Administrator, and Schroeder has signed this Agreement, in duplicate, the day and year first <br />written above. <br />Page 40 <br />
