/N MINUTES
CTTY COUNCIL
MARCH 25, 1998
Fahey pointed out that the City entered into an agreement with Brooks
Fiber which called for underground installation. After that agreement was
signed, Brooks Fiber requested an overhead installation in some areas.
The Council required compliance with the agreement. Fahey also pointed
out that the Brooks Fiber line which was installed through Little Canada
was a loop of a metropolitan line and was not serving Little Canada
residents.
Fahey further noted that this City has not required existing utilities with
overhead installations to bury their lines. However, the City does have an
ordinance which requires new utility installations to be buried, and the
requiring the Cable TV lines to be buried would be consistent with that
philosophy.
The City Administrator pointed out that a franchise renewal is the time
the City can impose this type of requirement. The Administrator also
pointed out that when Little Canada Road is reconstructed, the City will
request that NSP replace all overhead lines with underground. Morelan
agreed that now is the time to look at the issue.
Fahey indicated that his initial reaction is that it is unreasonable to require
the cable company to bury all their lines when other utilities are not being
required to do the same thing. The Brooks Fiber line was one that did not
serve the residents of the City. However, he would like to hear what
Meredith has to say about the issue.
Mr. Pedersen introduced the following resolution and moved its adoption:
RESOLUTION NO. 98 -3 -72 — DECLARING THAT IT 15 THE CITY
OF LITTLE CANADA'S INTENT TO REQUIRE MEREDITH CABLE
TO BURY ALL CABLE TV WIRES WHICH IT INSTALLS WITHIN
THE CITY AND TO REMOVE ALL WIRES, WHETHER OVERHEAD
OR BURIED, THAT ARE ABANDONED AS PART OF THE SYSTEM
UPGRADE AS WELL AS ANY SUPPORTING POLES WHICH ARE
NO LONGER REQUIRED
The foregoing resolution was duly seconded by Morelan.
Ayes (4) Pedersen, Morelan, Fahey, Scalze.
Nays (0). Resolution declared adopted.
REDEVELOP - The City Administrator recommended that the Council call for a workshop
MENT prior to the next Council meeting to discuss redevelopment of the Rice
WORKSHOP Street/Little Canada Road area.
Page 18
•
