MINUTES <br />CITY COUNCIL <br />SEPTEMBER 12, 2012 <br />Blesener introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2012 -9 -153 — AUTHORIZING THE <br />EXPENDITURE OF $600 FOR EXTENSION OF THE CITY'S <br />RAILROAD CROSSING PERMIT FOR ANOTHER YEAR AND <br />INSTRUCTING CITY STAFF TO WORK WITH THE RAILROAD, <br />ST. PAUL WATER DEPARTMENT, AND METRO TRANSIT ON <br />THE FILL ISSUES DISCUSSED THIS EVENING NEEDED TO <br />COMPLETE THE WATERWORKS TRAIL RAILROAD CROSSING <br />The foregoing resolution was duly seconded by McGraw. <br />Ayes (4). <br />Nays (0). Resolution declared adopted. <br />EASEMENT The City Engineer reviewed his report dated September 6, 2012 <br />CONFLICT relative to an easement conflict associated with the plans for the sewer <br />UPDATE interceptor slip lining project being undertaken by the City and the <br />Metropolitan Council. The Engineer noted that there was a backyard <br />structure, retaining walls, and landscape features constructed within the <br />existing easement area. To minimize the impact to these features, it was <br />proposed that a new easement be obtained from the property owner and a <br />realignment of this segment of sanitary sewer occur. The Engineer <br />pointed out that it was not possible to completely eliminate the conflict <br />with some of the landscaping features. <br />The Engineer stated that the property owner indicated that he would work <br />with the City on the easement swap, but requested compensation of <br />$15,000 for the removal and replacement of landscaping features. The <br />Engineer stated that he obtained quotes for this work which ranged from <br />$7,500 to $10,000. These quotes were based on pictures of the <br />improvements and a written description because the property owner had <br />already begun to dismantle the features himself. The Engineer indicated <br />that at no time did his office of City staff direct the homeowner to remove <br />or dismantle the landscape features. The Engineer reported that the <br />property owner has revised his compensation request to $10,000 and he <br />has signed the new easement document. <br />The Engineer noted that it has been the city's practice to work <br />cooperatively with homeowners on projects that are adjacent to their <br />homes regardless of whether or not the project is within the street right -of- <br />way or a utility easement. He noted that a similar situation to consider <br />would be the replacement trees along the Desai property on Dianna Lane. <br />The Council approved an expenditure of up to $2,500 for tree replacement <br />on that property. <br />10 <br />
