MINUTES <br />CITY COUNCIL <br />SEPTEMBER 12, 2012 <br />The Council discussed the property owner's request for $10,000, and <br />noted that while there is no obligation on the part of the City for <br />replacement of structures, landscape features, etc. within existing <br />easements, the City did appreciate the property owner's cooperation in this <br />matter. The City Administrator noted the issue of precedence and pointed <br />out that, in this case, the City would not be buying anything. Given the <br />property owner's cooperation, however, the City avoids the cost of <br />proceeding with an action against the property owner. Therefore, the <br />Administrator indicated that compensation of $3,000 would not be out -of- <br />line. <br />Montour introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2012 -9 -154 — AUTHORIZING PAYMENT OF <br />$3, 000 TO MR. SCHMIDT IN EXCHANGE FOR HIS <br />COOPERATION RELATIVE TO THE INTERCEPTOR SLIP LINING <br />PROJECT, AND NOTING THAT THE CITY WILL PAY THE COST <br />OF RECORDING THE NEW EASEMENT AND VACATION OF THE <br />OLD EASEMENT <br />The foregoing resolution was duly seconded by Boss. <br />Ayes (4). <br />Nays (0). Resolution declared adopted. <br />McGraw introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2012 -9 -155 — ACCEPTING THE SANITARY <br />SEWER EASEMENT OVER THE SCHMIDT PROPERTY AS <br />PRESENTED BY THE CITY ENGINEER SUBJECT TO REVIEW <br />AND APPROVAL BY THE CITY ATTORNEY <br />The foregoing resolution was duly seconded by Boss. <br />Ayes (4). <br />Nays (0). Resolution declared adopted. <br />The City Engineer indicated that plans are complete for the interceptor slip <br />lining project, and these plans must be submitted to the Metropolitan <br />Council for review and approval. The Engineer requested that the Council <br />call for bids for this project once the appropriate approvals have been <br />received. <br />Blesener introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2012 -9 -156 — AUTHORIZING THE CITY <br />ENGINEER TO ADVERTISE FOR BIDS FOR THE INTERCEPTOR <br />SLIP LINING PROJECT UPON APPROVAL OF PROJECT PLANS <br />11 <br />
