MINUTES <br />PLANNING COMMISSION <br />SEPTEMBER 13, 2012 <br />near the mobile home park. DeBace pointed out that the Hoggsbreath is <br />located adjacent to a mobile home park, and asked if Duray had noise <br />issues due to his business. Duray replied that sometimes he does deal with <br />noise issues. <br />Young pointed out that there are ways to do sound abatement within the <br />building if noise becomes an issue. The Planner indicated that the sound <br />abatement could be added as a condition of the CUP in the event it <br />becomes warranted. <br />Knudsen asked how long the dogs were out during the day. Young <br />reported that the dogs are indoors most of the time and let out occasionally <br />during the day. The latest dogs would be out would be from <br />approximately 8:00 to 8:30 in the evening and would then be within the <br />building over night. The Planner noted the condition that there be no dogs <br />outdoors from 10 p.m. to 6 a.m. and indicated that the Commission could <br />recommend more stringent hours. <br />Murphy recommended approval of the Text Amendment to allow animal <br />day care /kennels by Conditional use Permit in the Light Industrial (I -1) <br />District subject to compliance with the recommendations of the City <br />Planner as outlined in his report dated September 7, 2012. <br />Motion seconded by Maleitzke. <br />Motion carried 6 —1. Duray voted against. <br />Murphy recommended approval of a Conditional Use permit to operate an <br />animal day care /kennel at 407 South Owasso Blvd. requested by Jeffrey <br />Young subject to compliance with the recommendations of the City <br />Planner as outlined in his report dated September 7, 2012 and further <br />requiring that if there are noise complaints received relative to this <br />business that the City will work with the tenant and building owner on <br />noise abatement measures for the inside of the building or the Conditional <br />Use permit will he reopened to discuss resolution of the issue with the <br />tenant and building owner. <br />Motion seconded by Knudsen. <br />Motion carried 6 — 1. Duray voted against. <br />Duray indicated that he did not feel this type of business was conducive to <br />the area given the close proximity of the mobile home park. <br />-8- <br />
