Background and Analysis The applicant is seeking a Conditional Use Permit to construct an addition to an existing detached garage on his property at 3010 Edgerton Street. The property is zoned R -1, Single Family and is currently occupied by a single family home and a garage of 672 square feet. On single family parcels, garage floor area may be provided up to 1,000 square feet, or up to 1,500 square by Conditional Use Permit, under a series of conditions. The applicant is proposing to add 828 square feet to reach the maximum 1,500 square feet of area. Conditional Use Permits for detached garages exceeding the 1,000 square foot threshold are required to meet the following requirements: • Location in rear yard (except by special permit) • Setbacks from rear and side yard property lines of 10 feet • Structure height no more than 15 feet • Building area no more than 10% of the rear yard space • No other detached accessory buildings (such as garden sheds) may be allowed. • The structure must be compatible with the principal building materials • The structure must be used for residential storage only — no business activity The existing garage is located within the rear yard, but just 4 feet from the side property line. The applicant proposes to construct the addition farther to rear, and to meet the 10 foot setback by offsetting the new construction. The existing 4 foot setback is grandfathered to the extent that the existing non - conformity is not expanded. The applicant's proposal will meet this requirement. 4
