MINUTES <br />CITY COUNCIL <br />SEPTEMBER 26, 2012 <br />The Planner also reported that the property owner has some personal <br />storage in his building at 3032 Centerville Road. Personal storage is not <br />an allowed use; and that, too, would require an amendment to the Zoning <br />Ordinance to add that use to the I -P District. <br />Adam Meyer, attorney representing Ken Meyer, reported that Mr. Meyer <br />purchased a property with a lot of issues. Adam Meyer indicated that he <br />agreed with the City Attorney's position that re- establishing a non- <br />conforming use is not an option. He also pointed out that Mr. Meyer has <br />no formal application before the Council this evening. Mr. Meyer would <br />like some discussion of the issues to determine if a text amendment to the <br />Zoning Code is the appropriate avenue to pursue. Adam Meyer indicated <br />that a text amendment that would establish auto - related uses as a <br />conditional use may be the way to resolve the problem. Adam Meyer <br />noted that Mr. Meyer has spent a lot of money on this property, has made <br />repairs to the building and would like to re- establish the auto repair use on <br />the property as well as establish a car dealership on the property. <br />Ken Meyer, owner of 3032 Centerville Road, noted his August 16°i letter <br />to the Council and outlined the history of the property. With regard to that <br />letter, Meyer indicated he would like to correct his statements relative to <br />Mr. Winner and indicated that Mr. Winner no longer wants to operate in <br />Little Canada. Meyer reported that the property had been used as an auto <br />repair facility, and he was not aware that Mr. Winner did not renew his <br />licenses. Meyer reported that he received a letter from the City's Code <br />Enforcement Officer informing him that the there were no licenses for this <br />property and that the facility could not be used for auto repair nor outdoor <br />storage. <br />Ken Meyer reported that the building has been brought up to Code, and <br />any code violations where immediately corrected by him. Meyer reported <br />that the building was built and designed as an auto repair facility. To <br />make the building anything else is unrealistic. Meyer reported that he has <br />spent a tremendous amount of money and effort redoing the building, and <br />has now been placed in a situation where there is no place to go. Meyer <br />also pointed out that Mr. Dan King would like to utilize the site for auto <br />sales. Meyer reported that Mr. King is a very responsible individual and <br />shared his background with the Council. Meyer asked what procedure <br />could be used to allow the building to be used for auto - related uses. <br />Montour stated that he frequently drives by this property and pointed out <br />that the City has struggled with it for a number of years. Keis agreed, and <br />noted that in his letter Mr. Meyer indicates he put new siding on the <br />building. Keis asked where that siding is. Meyer reported that he <br />replaced a section of siding on the south wall. He also indicated that the <br />garage doors have been replaced and repainted and that the roof is new. <br />12 <br />
