MINUTES <br />CITY COUNCIL <br />SEPTEMBER 26, 2012 <br />PROPERTY <br />DIVISION, <br />COMBINATION, <br />REZONING — <br />WATERSHED <br />DISTRICT <br />TEXT <br />AMENDMENT <br />& CUP — <br />407 SOUTH <br />OWASSO BLVD: <br />YOUNG <br />The foregoing resolution was duly seconded by Boss. <br />Ayes (4). <br />Nays (0). Resolution declared adopted. <br />The City Administrator reported that the Ramsey Washington Metro <br />Watershed District has requested that action be tabled on their request <br />for Property Division subdividing a portion of 477 Little Canada Road <br />and Combination with 2665 Noel Drive as well as Rezoning the <br />subdivided property to Public (P) District until the October 24, 2012 <br />Council meeting. The Watershed has made application for an Amendment <br />to their Conditional Use Permit relative to their property, and would like <br />the City to process all these zoning actions at one time. A 60 -Day Waiver <br />has been obtained. <br />Montour introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2012 -9 -162 — TABLING ACTION ON PROPERTY <br />DIVISION, COMBINATION, AND REZONING AS REQUESTED BY <br />THE RAMSEY WASHINGTON METRO WATERSHED DISTRICT <br />UNTIL THE OCTOBER 24, 2012 COUNCIL MEETING <br />The foregoing resolution was duly seconded by McGraw. <br />Ayes (4). <br />Nays (0). Resolution declared adopted. <br />Montour opened the Public Hearing to consider an application for Text <br />Amendment to allow animal day care /kennels by Conditional Use Permit <br />in the Light Industrial (I -1) District as well as a Conditional Use Permit <br />to operate an animal day care /kennel at 407 South Owasso Blvd. East, <br />Jeffrey Allan Young. Montour noted that the Planning Commission <br />recommended approval of the Text Amendment and CUP subject to <br />compliance with the recommendations of the City Planner as outlined in <br />his September 7, 2012 report on a 6 to 1 vote. <br />The City Planner indicated that the Text Amendment would introduce a <br />new use in the I -1 District. He indicated that he is proposing this use be <br />regulated by Conditional Use Permit so that the City Council can review <br />applications and consider appropriate conditions. The Planner reviewed <br />the proposed conditions and standards as outlined in his September 7th <br />report. These include the CUP requirement, a business license <br />requirement, and various standards relative to location, fencing, <br />landscaping, odor control, maximum number of animals, and annual <br />inspections. The Planner noted that relative to location, he is proposing <br />that the dog day care /kennel be no closer than 200 feet from residentially <br />3 <br />
