MINUTES <br />CITY COUNCIL <br />SEPTEMBER 26, 2012 <br />that paved surface. The amendment defines what can happen in a side <br />yard as follows: <br />o Storage or parking closer than 10 feet from the property <br />line may be no greater than 6 feet in height — this would <br />accommodate nearly all passenger vehicles and light trucks <br />as well as storage of residential items up to that heights; <br />o Storage of materials or equipment that are not passenger <br />vehicles or light trucks in this area (up to 3 feet from the <br />property line) must be screened and landscaped; <br />o Storage of vehicles (such as recreational vehicles) that <br />exceed 6 feet in height must meet the required 10 foot <br />setback. <br />The Planner indicated that the idea behind the amendment is to clearly <br />define the storage and parking allowances within a side yard and the <br />varying requirements depending on setback and height. <br />Montour asked the type of storage that occurs in side yards. The Planner <br />indicated that items such as lumber, patio furniture, grills, utility trailers, <br />etc. Montour asked what category a pop -up camper would fall. The <br />Planner indicated that it would be an RV. Keis asked if boats and <br />snowmobile trailers would have to be screened. The Planner indicated <br />that anything under 6 feet in height that is not a vehicle or light truck and <br />is parked in the side yard up to 3 feet from the property line would have to <br />be screened. If stored 10 feet from the property line, screening is not <br />necessary. Anything over 6 feet would have to meet the 10 foot setback <br />requirement. Keis pointed out that these items could be stored in the back <br />yard and not screened as long as the 10 foot setback is met. <br />The City Administrator noted Section 903.020.D. talks about uses and <br />equipment and suggested that this section should be reviewed to determine <br />if an amendment is necessary. "fhe City Planner suggested that he do <br />some additional review to determine what cross - references are necessary <br />as part of the proposed Zoning Code Amendment. He requested this <br />matter be tabled until the November 28°i Council meeting. <br />The City Administrator pointed out the discussion at the Planning <br />Commission about whether or not the City receives complaints about this <br />type of parking /storage. The Administrator reported that complaints are <br />received and in most cases it is a non- issue. However, there are times <br />when this parking and storage in side yards becomes a large issue. The <br />Administrator felt the Ordinance Amendment was necessary to provide for <br />more clarity and consistency. <br />8 <br />
