Resolution declared adopted. <br />McGraw suggested that the City Administrator and the City Planner <br />undertake discussions with the business owner relative to noise abatement <br />measures that will have to be made should there be complaints. <br />McGraw introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2012 -9 -164 — APPROVING A CONDITIONAL <br />USE PERMIT TO OPERATE AN ANIMAL DAY CARE /KENNEL AT <br />407 SOUTH OWASSO BLVD. EAST REQUESTED BY JEFFREY <br />ALLAN YOUNG SUBJECT TO COMPLIANCE WITH THE <br />RECOMMENDATIONS OF THE CITY PLANNER AS OUTLINED IN <br />HIS SEPTEMBER 7, 2012 REPORT AND SUBJECT TO THE <br />RECOMMENDATIONS OF THE PLANNING COMMISSION <br />RELATIVE TO NOISE ABATEMENT WITH THE CITY <br />ADMINISTRATOR AND CITY PLANNER TO DISCUSS AND <br />DOCUMENT NOISE ABATEMENT MEASURES THAT WILL BE <br />NECESSARY IF THERE IS FOUND TO BE A VIOLATION OF THE <br />CODE, AND REQUIRING THE BUSINESS OWNER TO SUBMIT A <br />DETAILS SITE PLAN TO BE REVIEWED AND APPROVED BY <br />THE CITY ADMINISTRATOR AND CITY PLANNER WHICH <br />SHOWS COMPLIANCE WITH THE CODE STANDARDS <br />RECOMMENDED BY THE CITY PLANNER <br />The foregoing resolution was duly seconded by Montour. <br />Ayes (4). <br />Nays (0). Resolution declared adopted. <br />Montour opened the Public Hearing to consider an Amendment to the <br />Zoning Code relating to regulations for the parking of vehicles on <br />residential properties as well as storage in side yards. The Planning <br />Commission recommended approval of the Zoning Code Amendment <br />on a 6 to 1 vote. <br />The City Planner reported that the proposed amendment is a clarification <br />of the parking and storage that can occur in the side yards of residential <br />properties. He indicated that the current Zoning Code has a series of <br />regulations that are not always clear. There are difference setback rules <br />for different activities. The Planner noted that property owners are <br />allowed to pave up to 3 feet from the property line in a side yard. Once an <br />area is paved, the property owner assumes that anything can be stored on <br />7 <br />
