MnDOT is requesting municipal consent for this project as required by <br />State Statutes 161.162 through 161.167. This document is the submittal of the project report and <br />the final layout as required by State Statute 161.164. <br />State Statute 161.163 states that municipal consent applies only to projects that alter access, <br />increase or reduce highway traffic capacity, or require acquisition of permanent rights of way. <br />State Project 6280 -367 will not alter access or require acquisition of permanent rights of way. <br />State Project 6280 -367 will increase highway traffic capacity by adding an addition lane in each <br />direction, this additional lane will be a MNPASS lane, and as a result municipal consent is required <br />for this project. <br />State Statute 161.164 states that the city is required to: <br />• Schedule a public hearing within 15 days of receiving the final layout. <br />• Conduct the public hearing within 60 days of receiving the final layout. <br />• Provide a 30 -day notice of the public hearing. <br />• Approve or disapprove the layout by resolution within 90 days of the public hearing. <br />The resulting due dates for these activities are as follows: <br />• Date final layout and project report was submitted by MnDOT: October 10, 2012 <br />• Scheduling of public hearing must occur by: October 25, 2012 <br />• Public hearing must be conducted by: December 10, 2012 <br />• Approval or disapproval of the layout must occur by: March 10, 2013 <br />The public hearing required for municipal consent needs to be held separately from MnDOT's <br />hearings or meetings. The purpose of the municipal consent public hearing is for the city to gather <br />public comments on the project.
