B2 Roseville, MN 55113 Date: October 5, 2012 Mayor Bill Blesener City of Little Canada 515 Little Canada Road East Little Canada, MN 55117 PaEGEIVED DCT 'i >1 ?I117 CITY OF LITTLE CANADA RE: Submittal of Final Layout and Project Report for the I -35E MNPASS Project (SP 6280 -367) and Request for Municipal Consent Dear Mayor Blesener, MnDOT is proceeding with plans to add a MNPASS lane in each direction on I -35E from Maryland Ave. to Little Canada Road. MnDOT is requesting municipal consent for this project as required by State Statutes 161.162 through 161.167. This document is the submittal of the project report and the final layout as required by State Statute 161.164. State Statute 161.163 states that municipal consent applies only to projects that alter access, increase or reduce highway traffic capacity, or require acquisition of permanent rights of way. State Project 6280 -367 will not alter access or require acquisition of permanent rights of way. State Project 6280 -367 will increase highway traffic capacity by adding an addition lane in each direction, this additional lane will be a MNPASS lane, and as a result municipal consent is required for this project. State Statute 161.164 states that the city is required to: • Schedule a public hearing within 15 days of receiving the final layout. • Conduct the public hearing within 60 days of receiving the final layout. • Provide a 30 -day notice of the public hearing. • Approve or disapprove the layout by resolution within 90 days of the public hearing. The resulting due dates for these activities are as follows: • Date final layout and project report was submitted by MnDOT: October 10, 2012 • Scheduling of public hearing must occur by: October 25, 2012 • Public hearing must be conducted by: December 10, 2012 • Approval or disapproval of the layout must occur by: March 10, 2013 The public hearing required for municipal consent needs to be held separately from MnDOT's hearings or meetings. The purpose of the municipal consent public hearing is for the city to gather public comments on the project. At your request, MnDOT can have a representative on hand at the public hearing to answer questions. An Equal Opportunity Employer a
