MINUTES <br />CITY COUNCIL <br />JUNE 24, 1998 <br />that was granted for the house to the north. The property is currently <br />zoned B -3, and Krienke requested that the rezoning to RB not be finalized <br />until the purchase by the McMillan's is finalized. Krienke felt the coffee <br />shop would be a wonderful addition for the neighborhood and supported <br />the McMillan's request. <br />There was no one else from the general public present wishing to <br />comment on this matter. <br />Upon motion by LaValle, seconded by Pedersen, the public hearing was <br />closed. <br />Morelan asked why the City would rezone this lot and not the others <br />located to the east along County Road C which are zoned B -3. Morelan <br />suggested that to rezone just the one lot would be spot zoning. <br />LaValle stated that he did not consider this spot zoning, but rather a <br />transitional zoning. <br />Fahey suggested that these other lots would have less of an argument for a <br />variance given that the other lots are interior lots rather than corner lots. <br />Morelan felt that RB zoning was a good transitional use for the area, and <br />suggested that staff look at the feasibility of rezoning the remaining B -3 <br />lots to RB. Fahey suggested that staff prepare a recommendation for the <br />Council on this issue. <br />Morelan asked if the rezoning of 89 West County Road C could be <br />contingent upon the sale of the property. The City Attorney replied that it <br />could be. <br />Mr. LaValle introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 98 -6-150 — APPROVING THE REZONING OF 89 <br />WEST COUNTY ROAD C FROM GENERAL BUSINESS (B -3) TO <br />RESIDENTIAL BUSINESS (RB)CONTINGENT UPON <br />FINALIZATION OF THE REZONING UPON PURCHASE OF THE <br />PROPERTY BY DOUG AND JAN MCMILLAN, APPROVING THE <br />CONDITIONAL USE PERMIT FOR MIXED <br />RESIDENTIAL/COMMERCIAL USE AS REQUESTED BY THE <br />APPLICANTS, AND APPROVING A SIDE YARD SETBACK <br />VARIANCE WHICH WOULD RESULT IN A 22 FOOT SETBACK ON <br />THE WEST SIDE OF THE STRUCTURE AND A 10 FOOT SETBACK <br />ON THE EAST SIDE BASED ON THE FACT THAT THE CITY <br />CREATED A HARDSHIP IN THE DEVELOPMENT OF <br />Page 11 <br />
