MINUTES <br />CITY COUNCIL <br />JUNE 24, 1998 <br />FINAL PLAT <br />FOR PITRINA <br />PARK TERRACE <br />SECOND ADD. <br />MOM <br />Mr. LaValle introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 98 -6-148 —APPROVING THE AMENDMENT OF <br />THE CONDITIONAL USE PERMIT ALLOWING GORDIES' PLACE <br />TO CONDUCT OUTDOOR VOLLEYBALL SIX NIGHTS PER WEEK <br />UNTIL IO P.M. AS WELL AS THREE TOURNAMENTS PER YEAR <br />RESERVING THE RIGHT TO REVIEW THE CONDITIONAL USE <br />PERMIT SHOULD ANY PROBLEMS ARISE AS A RESULT OF <br />VOLLEYBALL <br />The foregoing resolution was duly seconded by Morelan. <br />Ayes (5) LaValle, Morelan, Pedersen, Scalze, Fahey. <br />Nays (0). Resolution declared adopted. <br />Council reviewed the final plat for Pitrina Park Terrace Second Addition. <br />It was noted that the Planning Commission has recommended approval of <br />the final plat subject to compliance with the recommendations of the City <br />Engineer and the Public Works Director. <br />Frank Frattalone, developer of Pitrina Park, asked for clarification of the <br />pedestrian path issue, noting that the City Engineer has pointed out that <br />the City's Code requires a 15 -foot wide easement. Council reviewed the <br />development agreement that provides for one pedestrian path, consisting <br />of a 12 -foot wide easement and 6 -foot wide path. The development <br />agreement also called for split rail fencing along the path. It was noted <br />that the Final Plat shows a 10 -foot wide path easement. <br />Morelan asked how the decision was arrived at that the path easement <br />should be 12 feet wide. Fahey suggested that the dimensions were <br />decided on by City staff. <br />Scalze suggested that there are other path easements in the City which are <br />10 feet in width. Morelan thought that other path pavement widths have <br />been 8 feet. <br />Fahey suggested that the path easement and paving issue be sent back to <br />City staff and the City Engineer for resolution. <br />Morelan asked if there was any compelling reason to require the plat to be <br />redrawn increasing the 10 -foot easement. The City Administrator <br />suggested that a solution might be for the developer to convey the <br />additional easement via a quit claim deed. The Administrator pointed out <br />that there are issues such as snow storage to consider. <br />4 <br />Page 10 <br />
