HF2920 FIRST ENGROSSMENT [REVISOR ) MS H2920-1 <br />1 (c) The report required under this subdivision must provide <br />2 for a separate accounting for all expenditures made from the <br />3 reporting organization's tax refund or credit authorized under <br />4 section 297E.02, subdivision 4, paragraph (d). <br />5 Sec. 3. Minnesota Statutes 1996, section 349.168, <br />6 subdivision 6, is amended to read: <br />7 Subd. 6. (COMPENSATION PAID HY CHECK OR ELECTRONIC <br />8 TRANSFER.) Compensation paid by an organization in connection <br />9 with lawful gambling must either be: (1) in the form of a check <br />10 drawn on the organization's gambling account, as specified in <br />11 section 349.19, and paid directly to the person being <br />12 compensated; (2) transferred electronically from the <br />13 organization's gambling account, as specified in section 349.19, <br />14 subdivision 3, directly to the employee's bank account; or (3) <br />15 transferred electronically to and from the account of a payroll <br />16 processing firm for payment to the employee's account and for <br />17 the payment of local, state, and federal withholding taxes, <br />18 provided that the payroll processing firm is (i) currently <br />19 registered with and meets the criteria of the department of <br />20 revenue as a third -party bulk filer under section 290.92, <br />21 subdivision 30, (ii) is able to provide proof of a third -party <br />22 audit and an annual report and statement of financial condition, <br />23 (iii) is able to provide evidence of a fidelity bond, and (iv) <br />24 can provide proof of having been in business as a third -party <br />25 bulk filer for the most recent three years. <br />26 Sec. 4. Minnesota Statutes 1997 Supplement, section <br />27 349.18, subdivision 1, is amended to read: <br />28 Subdivision 1. [LEASE OR OWNERSHIP REQUIRED.) (a) An <br />29 organization may conduct lawful gambling only on premises it <br />30 owns or leases. Leases must be on a form prescribed by the <br />31 board. Except for leases entered into before August 1, 1994, <br />32 the term of the lease may not begin before the effective date of <br />33 the premises permit and must expire on the same day that the <br />34 premises permit expires. Copies of all leases must be made <br />35 available to employees of the board and the division of alcohol <br />36 and gambling enforcement on request.
