MVIINJ 1 LS <br />CITY COUNCIL <br />JUNE 25, 1997 <br />REZONING <br />AS WELL AS <br />VARIOUS <br />ZONING AND <br />SUBDIVISION <br />APPROVALS — <br />TUFFY'S <br />AUTO CENTER <br />COMPLIANCE WITH THE RECOMMENDATIONS OF THE CITY <br />PLANNER AS OUTLINED IN HIS REPORT DATED JUNE 10, 1997 <br />The foregoing resolution was duly seconded by LaVaile. <br />Ayes (5) Scalze, LaVaile, Morelan, Pedersen, Scalze. <br />Nays (0). Resolution declared adopted. <br />Mayor Fahey opened the Public Hearing to consider the application <br />for Rezoning to B -2 as well as other various Zoning and Subdivision <br />approvals in order to construct a five (5) bay, 3,680 square foot auto <br />service facility for Tuffy Auto Service Centers on the property <br />located at approximately 2310 Rice Street. Fahey pointed out that the <br />Planning Commission recommended approval of the proposal subject <br />to several conditions. Fahey asked if the proposal was consistent with <br />the City's Comprehensive Plan. <br />The City Planner replied that the area along Rice Street south of the school <br />property is an appropriate area for auto - related uses. The Planner pointed <br />out that McDonald's, Hardees, Fina, Bob's Cycle exist in this area and are <br />consistent with B -2 type uses. <br />Fahey indicated that he thought the point of the City's work in planning <br />for Rice Street was to restrict 13-2 uses. <br />The Planner pointed out that there are currently no B -2 zoned properties <br />within the City. Previously, the City's Zoning Code provided for 3-1 and <br />3-2 uses to rollover into 13-3. The City eliminated this rollover provision <br />and currently anyone proposing a 13-2 use will also have to request a <br />rezoning to 3-2. <br />Scalze indicated that her recollection is that the Council had reasons for <br />eliminating the B -2 rollover, and stated that she does not remember <br />anyone suggesting the area south of the school be rezoned to 13-2. <br />The City Planner pointed out that the Development Guide discusses the <br />node concept and separating commercial uses with other uses. The Comp <br />Plan includes discussion of auto - related commercial uses south of the <br />school property because of the proximity to the freeway interchange. <br />Scalze suggested that anything can be called a node, and questioned when <br />a node became spot zoning. <br />Morelan pointed out that the City never had any 13-2 zoning, just B -3 with <br />3-2 uses rolling in.
