<br /> <br />C. RENTS. LEASES, AND PROFITS <br />Together with all rents and profits now due or which may hereafter become due under or <br />by virtue of and together with all right, title and interest of Mortgagor in and to any lease, license, <br />sublease, or agreement, whether written or verbal, for the use or occupancy of the Premises or any <br />part thereof; and <br />D. JUDGMENTS AND AWARDS <br />Together with any and all awards or compensation made by any governmental or other <br />lawful authorities for the taking or damaging by eminent domain or the whole or any part of the <br />Premises, including any awards for a temporary taking, change of grade of streets, or taking of <br />access. <br />AND MORTGAGOR does covenant with Mortgagee, its successors and assigns, that <br />Mortgagor is lawfully seized of the Premises and has good right to sell and convey the same; <br />that Mortgagee, its successors and assigns, shall quietly enjoy and possess the Premises; that <br />Mortgagor will warrant and defend the title to the same against all lawful claims not specifically <br />set forth as permitted encumbrances in Exhibit B (the "Permitted Encumbrances") attached hereto <br />and made a part hereof; and that all buildings, improvements, and fixtures now or hereafter located <br />on the Premises are, or will be, located entirely within the boundaries of the Premises. <br />TO HAVE AND TO HOLD THE SAME, together with the possession and right of <br />possession of the Premises, unto Mortgagee, its successors and assigns, forever. <br />PROVIDED, NEVERTHELESS, that if Mortgagor strictly observes and performs all of <br />the covenants, agreements, and provisions of this Mortgage, the Loan Agreement, the Note, and <br />any other LCDA Loan Documents, or if Mortgagor shall pay or cause to be paid all the <br />indebtedness, plus accrued interest, secured by this Mortgage, including any renewals or <br />extensions thereof, following or due to default by Mortgagor on said covenants, agreements, and <br />provisions, then this Mortgage and the estate, right, and interest of Mortgagee in the Premises shall <br />become null and void; otherwise this Mortgage shall be and remain in full force and effect.
