January 23, 1998 <br />City of Little Canada <br />515 Little Canada Road <br />Little Canada, MN 55117 <br />Re: Arcade Street <br />Utility & Street Improvement Project <br />BRA File No. 37231 <br />Honorable Mayor & City Council Members: <br />As per Section 3.9 of the Conditions of the Contract, we hereby recommend that liquidated damages be <br />imposed on the City portions of the above referenced contract. We recommend that liquidated damages be <br />imposed at a rate of $400 per calendar day as specified in Addendum No. 1, for each section of the <br />contract which is in noncompliance. The Ramsey - Washington Metro Watershed District does not wish to <br />impose liquidated damages on their portion of the contract (Section 4). <br />Ryan Contracting failed to meet the completion date on all four City parts of the contract. We are not <br />aware of any unavoidable delays that affected progress controlling operations of the Contractor. Based on <br />the information available to us, we have calculated liquidated damages as shown on the attached sheet. A <br />summary is as follows: <br />Liquidated <br />Days Damages <br />Section 1 Arcade, Keller to Labore 1 $400 <br />Section 2 Arcade, Labore to Westwind 32 $12,800 <br />Section 3 Arcade, Westwind to CR D 32 $12,800 <br />Section 4 Ramsey -Wash. Metro Ditch 7A - -- <br />Section 5 Westwind /Windrow Culverts 22 $6,400 <br />$32,400 <br />These calculations take into account the extension of time which was approved by the Engineer and the <br />City in August, 1997.
