Olson indicated, however, that he would try to save as many trees <br />as possible. <br />Knudsen asked for an explanation of hardship. <br />The City Planner reported that a hardship must be something unique to the <br />property which prevents the reasonable use of the property. In this <br />particular situation, three units rather than four units would be considered <br />a reasonable use of the property. Therefore, denial of the setback variance <br />does not prevent the reasonable use of the property. <br />Barraclough asked if the drainage easement through the southern portion <br />of the site would create a hardship. The Planner pointed out that it would <br />still be possible to develop the site with three townhome units. <br />Knudsen pointed out that the issue is one of precedent and consistency. <br />Knudsen suggested that the existence of the easement brought the hardship <br />issue closer to reality. The Planner indicated that it may bring the issue <br />closer, but again, it comes down to the reasonable use of the property. <br />Mr. Knudsen recommended the approval of the rezoning of 216 East <br />County Road B -2 from Single- Family Residential (R -1) to Medium <br />Density Residential (R -2). <br />Motion seconded by Carson. <br />Motion carried 6 — 0. <br />Mr. Montour recommended that the Variance allowing encroachment of a <br />porch into the 30 -foot required rear yard setback be denied based on the <br />fact that a hardship does not exist. <br />Motion seconded by Keis. <br />Motion carried 5 — 1. Mr. Barraclough voted against. <br />Mr. Barraclough recommended approval of the Preliminary and Final Plat <br />known as Viking Estates, a 4 -unit townhome development, subject to <br />compliance with the recommendations of the City Planner as outlined in <br />his report dated May 11, 1998. <br />Motion seconded by Knudsen. <br />Motion carried 6 — 0. <br />4 <br />Page 17 <br />
