Historical Society Addition <br />Page Four <br />J. • <br />Construction Managers actions shall be taken with reasonable <br />promptness so as to cause no delay in the Work or in the <br />activities of the Owner or Contractors. <br />The Construction Manager shall develop and implement procedures <br />for the review and processing of applications by Contractors <br />for progress and final payments. Based upon the Construction <br />Manager's observations and evaluations of each Contractor's <br />Application for Payment, the Construction Manager shall review <br />and certify the amounts due the respective Contractors. the <br />Construction Manager shall then prepare a Project Application <br />for Payment based upon the Contractor's Certificates for <br />Payment for gubmission to the Owner. <br />k. With respect to each Contractor's own Work, the Construction <br />Manager shall not have control over or charge of and shall not <br />be responsible for construction means, methods, techniques, <br />sequences or procedures, or for safety precautions and pro- <br />grams' in connection with the Work of each of the Contractors, <br />since these are solely the Contractor's responsibility under <br />the Contracts for Construction. The Construction Manager shall <br />not be responsible for a Contractors failure to carry out the <br />Work in accordance with the respective Contract Documents. <br />The Construction Manager shall not have control over or charge <br />of acts or omissions of the Contractors, Subcontractors, or <br />their agents or employees, or any other persons performing <br />portions of the Work not directly employed by the Construction <br />Manager. <br />1. The Construction Manager shall maintain for the Owner one copy <br />of all Contracts, Drawings, Specifications, Addenda, Change <br />Orders and /or Modifications, marked currently to record <br />changes and selections made during the Project. The above to be <br />forwarded to the Owner upon completion of the Project. The <br />Construction Manager shall also forward any Equipment Manuals <br />to the Owner. <br />m. When the Construction Manager considers a Contractor's Work <br />to be substantially complete, the Construction Manager shall <br />prepare a list of incomplete or unsatisfactory items and a <br />Schedule for their Completion. <br />n. The Construction Manager shall prepare and forward to the Owner <br />a Final Application for Payment upon compliance with the re- <br />quirements of the Contract Documents. <br />o. The Construction Manager shall provide "'.sy, services <br />made necessary by the termination or default of the Architect <br />or a Contractor, by major defects or deficiencies in the Work <br />of a Contractor, or by failure of performance by a Contractor <br />under the Contract for Construction. <br />
