The Owner shall pay for <br />all testing required by the Contract Documents. The Owner shall <br />furnish all legal, accounting and insurance counseling services as <br />may be necessary at any time for the Project. <br />The cost of the Project shall be <br />including Architectural Fees and <br />Construction Start Date is to bo <br />Completion of Construction to be <br />established as <br />Contingencies. <br />approximately <br />by August 28, <br />being $250,000.00 <br />April 20, 1998 with <br />1998. <br />Prior to the Start of Construction, the Construction Manager shall <br />furnish the Owner with a Certificate of Insurance with limits as <br />per the following: <br />A. Workmen's Compensation and Employer's Liability Insurance: <br />Shall be secured and maintained as required by the State of <br />Minnesota. <br />B. Public Liability, personal Injury and Property Damage: <br />1. Injury or death of one person <br />2. Injury to more than one person in a <br />single accident <br />3. Property damage <br />C. X -CXU Hazards: Same limits as for (B) above <br />$500,000 <br />$500,000 <br />$100,000 Each <br />$200,000 Aggregate <br />D. Automobile and Truck Public Liability, Personal Injury and <br />Property Damage, including Owned and Non -Owned Vehicles: <br />1. Injury or death of one person <br />2. Injury to more than one person in a <br />single accident <br />3. Property damage <br />$250,000 <br />$500,000 <br />$100,000 Each <br />$200,000 Aggregate <br />Compensation for the above Construction Management Services shall be <br />based upon the Fixed Fee of $13,500.00 and shall be due and payable <br />monthly in direct proportion to the completion of the Project as <br />indicated by the Application for Payment for that month. Said Fee <br />shall also include all customary and normal reimbursable expenses <br />associated with the performance of these Services other than those <br />excluded elsewhere in this Agreement. <br />This Agreement may be terminated by either party upon not less than <br />seven days written notice should the other party fail substantially <br />to perform in accordance with the terms of this Agreement through no <br />fault of the party initiating the termination. <br />
