MINUTES CITY COUNCIL OCTOBER 10, 2012 *APPROVAL OF THE VOUCHERS; *APPOINTMENT OF ABSENTEE BALLOT BOARD & ELECTION JUDGES FOR NOVEMBER 6, 2012 GENERAL ELECTION; *APPROVAL OF 32ND RIDER AGREEMENT WITH ST. PAUL WATER RELATIVE TO RAILROAD TRAIL CROSSING AND AUTHORIZING THE MAYOR AND CITY ADMINISTRATOR TO EXECUTE ON BEHALF OF THE CITY The foregoing resolution was duly seconded by Boss Ayes (4). Nays (0). Resolution declared adopted. DAR & DAS The City Attorney reported that many of the cases that his office DIVERSION prosecutes (approximately one - third) are related to driving after PROGRAM suspension /revocation. The high number of these cases puts an undue burden on the court system. The Attorney also pointed out that many people need to drive in order to keep their job. The Attorney reported that there is a Driving Diversion Pilot Program available that his office would like authorization to participate in and which addresses these issues. He also noted that the Ramsey County Sheriff's Department is in support of this program for its contracting cities. Under the program offenders would be issued a provisional license that would be valid as long as the person is participating in the diversion program. This pilot program would be run by Diversion Solutions, LLC, a for -profit company. The Attorney reported that, to date, the Cities of Shoreview and Arden Hills are participating. Keis asked if this participation in this program was limited to a first offense. The City Attorney was not sure, but noted that the judge would have to approve offenders for this program. Keis introduced the following resolution and moved its adoption: RESOLUTION NO. 2012 -10 -177 — APPROVING THE DRIVING DIVERSION PROGRAM SERVICES AGREEMENT WITH DIVERSION SOLUTIONS, LLC AND AUTHORIZING EXECUTION OF THE AGREEMENT BY THE LITTLE CANADA CITY ATTORNEY The foregoing resolution was duly seconded by Montour. Ayes (4). Nays (0). Resolution declared adopted. 2
