MINUTES <br />CITY COUNCIL <br />OCTOBER 10, 2012 <br />AUTO USES The City Administrator noted that at its September 26, 2012 meeting <br />MORATORIUM the Council adopted an ordinance establishing a twelve month moratorium <br />prohibiting the application for and /or issuance of licenses or zoning <br />approvals, and /or the operation of new business premises for the following <br />uses: <br />Automobile Repair, Minor; <br />Automobile Repair, Major; <br />Automobile Repair, Salvage; <br />New or Used Automobile Sales, Indoor; <br />New or Used Automobile Sales, Outdoor Lots; <br />Junking or Salvage of Automobiles; <br />Sales of Used Parts from Used or Salvage Vehicles. <br />The City Administrator reported that since the adoption of the ordinance a <br />number of issues have arisen with potential businesses. Staff informed the <br />potential applicants of the moratorium and the inability to process license <br />applications or zoning modifications. However, some of these parties <br />would like to discuss their concerns with the Council, and are present this <br />evening. The Administrator then provided a brief history on each situation <br />related to the property owners present as outlined in his October 4, 2012 <br />report. These include: <br />• Balta's Auto Towing Service that had been located in 3176 <br />Ryan Lane (Russ Fischer property) and has moved to 3164 <br />Ryan Lane (Lee Rossow property); <br />• Dominic Carchedi at 182 Ryan Lane, Space C (Dave Evans <br />property); <br />• Roger Stanke property at 209 Ryan Drive; <br />• Jimmy at 182 Ryan Lane, Space B (Dave Evans property); <br />The City Administrator reported that the question has been raised relative <br />to renewal of existing auto - related licenses, He pointed out that existing <br />licenses are excluded from the moratorium and would be renewed <br />provided there are no violations on a property. <br />With regard to Dominic Carchedi, the City Administrator pointed out that <br />Mr. Carchedi made application for a license prior to enactment of the <br />moratorium ordinance. The Administrator asked the City Attorney if the <br />City was obligated to act on that license application. The City Attorney <br />noted that the moratorium prohibits the City from issuing any auto - related <br />use license. Therefore, action cannot be taken on the Carchedi <br />application.
