MINUTES <br />CITY COUNCIL <br />OCTOBER 10, 2012 <br />for a period of one year to give the City an opportunity to study auto - <br />related uses. However, the actual length of the moratorium could be <br />shorter depending on when the results of the study are presented to the <br />Council. Once the study is received and action taken by the Council to <br />either amend current regulations or let them stand as currently, the Council <br />can then lift the moratorium. <br />Blesener asked if the Council could repeal the moratorium at any time and <br />reinstate it at any time. The City Attorney replied that the Council could. <br />He noted that the purpose of a moratorium is to maintain the status -quo <br />while City staff is conducting its study. Blesener asked if the moratorium <br />could be repealed with the study being completed. The City Attorney <br />replied that it could. <br />Roger Stanke, 209 Ryan Drive, stated that he is disappointed that the <br />moratorium was put in place and indicated that he has tried to maintain a <br />good property watching his renters very closely. Stanke indicated that his <br />tenants have tended to be long -term renters and has had little turn over. <br />Stanke pointed out the property taxes he pays and indicated that he needs <br />to keep his building occupied. Stanke indicated that the only rental calls <br />he is getting are for auto - repair uses, and the moratorium is prohibiting <br />him from renting to this use, thus costing him rental income. Stanke <br />stated that he does not want auto- repair salvage or a paint booth in his <br />building. Stanke felt if there have been no problems on a property, the <br />building owner should be able to rent space without the impact of this <br />moratorium. <br />Stanke also reported that with regard to the auto repair -minor and auto <br />repair -major licenses, he was at the Goodyear business on Rice Street and <br />indicated that there is major auto work being done even though that <br />business only has an auto repair -minor license. Stanke stated that there <br />were 4 or 5 cars without motors or transmissions, an employee was cutting <br />the doors off a vehicle, and there were 5 vehicles being stored behind the <br />building. <br />Blesener noted that City staff recommended enactment of the moratorium <br />in order to study the issue of auto - related uses in reaction to the fact that <br />businesses are moving in and out of buildings, businesses are operating <br />without the proper licensing, etc. Staff felt it was time to look at the <br />City's ordinances to see if there was the need to strengthen /clarify auto - <br />related use regulations. <br />Keis pointed out the work that the City and Ryan Industrial Park property <br />owners did a couple of years ago in clarifying outdoor storage regulations. <br />Keis noted that the intention is the same in the case of to auto - related uses. <br />4 <br />
