Blesener noted that it is auto repair - <br />salvage and indoor and outdoor auto sales that cause most of the issues. <br />He suggested that there may be a temporary solution for the property <br />owners. <br />Montour responded to Rossow's comments about having a blanket CUP, <br />noting that CUPs provide the City with a level of control. His concern <br />was that the entire Ryan Industrial Park may be filled with auto repair - <br />salvage businesses. Rossow felt that could be controlled via licensing. <br />The CUP would be generic, but the licensing would be specific. <br />Keis agreed that the CUP process provides the City with a level of control <br />about what goes in a property, as well as a future code enforcement tool. <br />Keis felt it would be difficult to draft generic conditions given the variety <br />of properties in the I -1 District. The City Attorney agreed that a CUP is an <br />enforcement tool and provides the ability to address varying conditions. <br />Keis noted that there are good property owners and there are bad ones as <br />well as good tenants and bad ones. Keis pointed out that some businesses <br />indicate they need a license for auto repair -major and the reality is that <br />there are 10 salvage vehicles on the site. Keis asked how the City was <br />supposed to get a handle on those situations. Rossow replied that his lease <br />agreements say a vehicle cannot be on the property more than 45 days. If <br />it is, he then has the vehicle towed. Blesener pointed out that not all <br />business owners manage their properties like Rossow. Rossow urged the <br />Council to have faith in what the property owners are doing because they <br />want the park to look good. Rossow felt there was a compromise that <br />could be worked out. <br />Stanke asked why the property owners were not notified of the <br />moratorium and asked why a moratorium had to be in place while this <br />issue was studied. The City Administrator noted that there is no legal <br />obligation to notify property owners when a moratorium is being put in <br />place. He indicated that the City is putting together a letter informing <br />property owners of what this moratorium means. I -Ie pointed out that the <br />moratorium maintains the status quo and gives the City the opportunity to <br />study the auto - related use issues. <br />The Administrator pointed out that businesses and uses in Ryan Industrial <br />Park change and it has been difficult to keep up with this. He also noted <br />the difficulty in interpreting the difference between auto repair -major and <br />miner as currently defined by the City's ordinance. He agreed that it may <br />be possible to come up with something that is more flexible for the <br />property owners. The Administrator indicated, however, that the auto <br />related uses warrant study so that the City can come up with some fair and <br />consistent regulations.
