MINUTES <br />CITY COUNCIL <br />OCTOBER 10, 2012 <br />the property owner can take out a CUP that can be utilized by a tenant. <br />However, a business license is specific to the business and is not <br />transferrable. <br />Rossow asked if the City could suspend any enforcement action until the <br />moratorium is lifted. He indicated he did not want Balta's Towing to <br />move out of the property. <br />The Attorney indicated that the purpose of the moratorium is to maintain <br />the status quo while the City studies auto - related uses. The Attorney <br />noted, however, that the Council can modify the moratorium ordinance to <br />create exceptions to it. <br />Blesener felt the moratorium should stay in place for auto repair - salvage <br />and auto sales, either lifting the moratorium or creating a temporary grace <br />period for auto repair -minor and auto repair- major. The Administrator <br />suggested that a temporary grace period could be created for the auto <br />repair -minor and auto repair - major. The downside is that if tenants leave <br />and the grace period is no longer in place, the building owners will again <br />be unable to lease to these uses. <br />There was discussion about the appropriate length of a grace period with <br />the building owners indicating that 60 days would not be enough. Keis <br />suggested that it may be possible to complete the study in less than a year. <br />So if the thought is to grant a grace period on the front end and shorten the <br />length of time for the study lifting the moratorium before 12 months has <br />lapsed, Keis suggested an exemption for auto repair -minor and auto <br />repair -major from the moratorium. <br />The property owners indicated that even a grace period to the end of the <br />year would not work for them. Therefore, expressed their support for <br />exempting auto repair -minor and auto repair -major from the moratorium. <br />Rossow asked if the Council would consider exempting auto repair - <br />salvage as well as this is a license that Balta's Towing would like. The <br />City Administrator noted some of the issues relative to the Balta's Towing <br />operation at the Russ Fischer building. <br />Keis indicated that it was his position that auto repair- salvage and the auto <br />sales uses should remain under moratorium. He noted that lifting the <br />moratorium on auto repair -minor and major did not mean that these uses <br />would not be studied and changes made. Keis suggested that businesses <br />existing before zoning regulation changes are made, but would be <br />grandfathered in and not subject to the new regulations. The City <br />Administrator replied that that was correct. <br />9 <br />
