WORKSHOP MINUTES <br />CITY COUNCIL <br />AUGUST 28, 2024 <br /> <br /> <br /> <br /> <br /> <br />3 <br />Kwapick asked if a new businesses were more likely to be built. Director Harrington outlined <br />usually high commercial buildings and putting a lot of money into businesses and try to make it an <br />attractive business. <br /> <br />T. Miller outlined there is not a lot of space for retail. Mayor Fischer outlined he has a sour taste in <br />his mouth from smoke shops. Kwapick outlined starting with one and if there are a lot of requests, <br />to expand, but agreed with Fischer about the smoke shops. <br /> <br />T. Fischer asked if licenses get issued by the state, and wondered if it was first come first serve for <br />any applicants. H. Heller outlined we would need to create a process. Attorney Johnson outlined <br />you can do first come, first serve, have a ranking process, and make sure it is not capricious. <br />Attorney Johnson outlined there is likely demand based on location to highways (35 and 694). <br /> <br />Administrator Heineman outlined the visibility of a specific site 0 – the “minoks” site by doc 86 and <br />gymnastics site which does not fall into an limitations with buffers. <br /> <br />Director Harrington outlined the map that was shared of the zoning buffers. The preference of staff <br />is to do retailers in commercial spaces – non-retailers in the I1 space, as this is a potent substance. <br />Commercial for retailers. <br /> <br /> Tentative – one retailer <br /> <br />Harrington asked - Where does the Council want to see retailers and non-retailers located? <br /> <br />Mayor Fischer outlined that 90% of retailer locations, based on the buffers, are in the west part of <br />the industrial park. Harrington asked about the I1 and I2 differences and considerations. He stated <br />that I1 would likely be a potential area that could have other implications. Mayor Fischer asked if <br />anyone had appetite for anything outside of I1 <br /> <br />Fischer asked about growers, and if they could be limited. Attorney Johnson outlined that you <br />cannot cap growers and manufacturers and micro and mezzo businesses. The differences are in sizes <br />for growing and if sampling is allowed. She outlined it was unlikely there would be outdoor <br />growers and that the market was headed towards edibles. <br /> <br /> In short, retail business – C1, everything else in I1. <br /> <br />Mayor Fischer for clarification about license types which was clarified – if the city gets one retail <br />location, the city has met the one qualification and does not need a mezzo or micro business. <br />Fischer mentioned there could be shifts in type of businesses in the industrial going forward. <br /> <br />Attorney Johnson mentioned these businesses are all cash businesses and there could be safety <br />concerns. She articulated that a security plan is required for the state, and the safety of a cash <br />business should be considered in addition to orders. <br /> <br />A.Gurierrez outlined her past experience in Arizona, and it was a business with a drive-through, full <br />kitchen and mentioned the security levels she experienced, and noticed no order.
