Fischer outlined that these businesses <br />make it attractive. <br /> <br />D. Miller clarified the location requirements. Attorney Johnson provided a reminder about state <br />caps. Fischer mentioned the similar experience with microbreweries. <br /> <br />240 throughout the entirety of the state is what Harrington mentioned would be through 2026 that <br />could be issued through preapproval. H.Heller clarified that this was to help cities see who has been <br />approved by the state. <br /> <br />163 for the top three was calculated. <br /> <br />I1 west of 35E, Gutierrez outlined there might be a vacant property in I2 where work is currently <br />occurring. Kwapick asked about the area around Centerville Road north of Allen. Harrington <br />outlined code enforcement around the Centerville area has been a concern, and would recommend <br />not moving forward. <br /> <br />D. Miller asked about over by B – I1 – Harrington stated if adopting the 1,000-foot buffer from the <br />school solves the concern. For retailers, Harrington asked about C1 and C2. Kwapick is hesitant <br />about C2 because of residential. Harrington outlined that you could limit it to mixed-use properties. <br /> <br />D.Miller asked about the number of retailers and feels it is the same as <br /> <br />C1 and C2 are okay adjuncts, but not mixed-use. <br /> <br />Gutierrez asked if we should be talking about buffers first. <br /> <br />Would the Council like to see a CUP/IUP requirement <br /> <br />Harrington stated there could be additional requirements to do condition use permits and wanted to <br />clarify the council’s support. T. Fischer asked how a CUP could be denied. Attorney Johnson stated <br />you can put conditions in CUPs that give the council teeth. T. Fischer stated the city denied a <br />tobacco license, and the council has been through something similar. CUP is for specific applicants <br />based on Attorney Johnson's analysis and allows them to be transferred, which is why she wants the <br />CUP to be tied to a specific applicant. <br /> <br />T. Fischer asked for clarification. Attorney Johnson articulated a condition in the CUP by outlining <br />a condition that X applicant needs to have a state license. <br /> <br />H.Heller asked if it could be tied to name, which Attorney Johnson said no. She additionally <br />articulated the explanation of the CUP process. H.Heller asked about license number and <br />transferring, and Attorney Johnson stated being specific is key. She articulated that interim use <br />permits will not be allowed. <br /> <br />Does the Council want to see restrictions near residential properties?
