MEMORANDUM <br />TO: Mayor Blesener & Members of City Council <br />FROM: Joel Hanson, City Administrator <br />DATE: November 28, 2012 <br />RE: MnPass — Revised Draft - Potential Conditions of Approval <br />The Council has set a public hearing for 7:30 p.m. on Wednesday, November 28th to <br />consider granting Municipal Consent to the proposed MnPass project on I -35E from <br />Little Canada Road to Maryland. The City may impose conditions on our approval. <br />MnDot can choose to accept the conditions or reject them and move to an appeal process. <br />Here is a listing of conditions that have been discussed for consideration: <br />A. Remove brush from fence and established plantings on I -35E right -of -way <br />along Country Drive from Water Works area to Little Canada Road <br />B. In coordination with the City and work on MnDot's storm sewer pipes <br />transversing under Country Drive and I -35, address necessary repairs to the <br />City's 15" storm sewer inlet on Country Drive to eliminate the cause of the <br />sinkhole in this area. <br />C. Reimburse the City for its cost to upgrade the Little Canada Road Bridge in <br />2010. (Reimbursement to the City may be by direct payment or some other <br />improvement that results in a dollar offset equal to or greater than the amount <br />indicated below. Background: MnDot claimed this bridge was not in the <br />Unweave the Weave project area and required the City to enter into a <br />Cooperative Agreement (No. 95132 — S.P. 6280 -357) to have the outdated <br />fencing removed from the concrete sidewalls and to paint the bridge & <br />abutments. Given all of the work that has been done in this corridor and paid <br />for by MnDot, it isn't fair to the residents of Little Canada that they had to fund <br />50% of the costs for basic bridge improvements that should have been part of <br />the. The total costs for the project totaled $126,961.20 less the $50,000.00 <br />reimbursement from MnDot for a City share of $76,961.20. <br />
