MINUTES <br />CITY COUNCIL <br />FEBRUARY 28, 2007 <br />The City Administrator asked if surety should be required to ensure that <br />the high rise sign is removed as required by the CUP. The City Planner <br />indicated that the City could revoke the CUP or citations should be issued <br />to the property owner. <br />Mr. Montour introduced the following resolution and moved its adoption: <br />RESOL UTION NO.2007 2-95 -DENYING THE VARL4NCE TO <br />ALLOW SIGNAGE EXCEEDING THE TOTAL SQUARE FOOTAGE <br />AS WELL AS MAXIMUMNUMBER OF SIGNSALLOWED BY THE <br />ZONING CODE BASED ON THE RECOMMENDATION OF THE <br />PLANNING COMMISSION THAT THERE IS NO HARDSHIP <br />PRESENT TO WARRANT GRANTING THE VARL4NCEAND <br />BASED ON THE FACT THAT NO EFFORT TO ACHIEVE <br />COMPLL4NCE.IIAS BEENMADE <br />The foregoing resolution was duly seconded by Keis. <br />Ayes (4). <br />Nays (0). Resolution declared adopted. <br />Blesener opened the Public Hearing to consider a request for Planned <br />Unit Development Permit to allow for an interim use of commercial <br />property for a private auto repair hobbyist at 2968 Rice Street as <br />requested by Marilyn Montreux. Blesener noted that the City Planner <br />and Planning Commission have recommended approval subject to <br />conditions. Blesener also noted that letter that was submitted by Mr. <br />Henry W. Anderson indicated that his sole use of the property is as a <br />hobby shop and storage facility. <br />Marilyn Montreux reported that she has made application for an Interim <br />Use Permit so that Mr. Anderson could continue renting this property. <br />She indicated that one issue of concern has been that there are no <br />bathroom facilities in the rental garage. Montreux indicated that the house <br />is no longer being rented and Mr. Anderson has access to the house for use <br />of these facilities. <br />Blesener asked what Mr. Anderson's hobby is. Montreux stated that she <br />believes he works on race cars, both his own and for others. Montreux <br />indicated that she was not sure, however. Blesener asked what Mr. <br />Anderson does for a living. Montreux replied that she believes he is a <br />carpet layer. She reported that due to flexibility in his job, Mr. Anderson <br />works at his hobby both during the week and on weekends. <br />Keis asked if access to bathroom facilities that are in the house was <br />adequate. The City Planner felt that was acceptable from a code <br />285 <br />
