It <br />was not an acceptable situation when the house was rented to one <br />individual and the garage space was rented to Mr. Anderson and he had no <br />access to bathroom facilities. <br />McGraw stated that his concern was with comments made at the Planning <br />Commission meeting that Mr. Anderson was at the facility five days per <br />week, eight hours per day. Montreux stated that she is not familiar with <br />that comment. The City Planner indicated that the City's code <br />enforcement personnel indicated that Mr. Anderson is at this rental facility <br />routinely during the week. <br />McGraw pointed out that there is no way of knowing whether or not this <br />will turn into an auto repair. McGraw stated that he was concerned that <br />the interim use permit would be passed on from one individual to another. <br />McGraw was concerned that if the issue ever went to court, the court <br />would order the interim use permit be passed on to a similar user. <br />Keis asked how long Mr. Andersonhas been renting the property. <br />Montreux estimated seven years. Blesener pointed out that the City has <br />been trying to get this properly cleaned up for the past seven years. <br />Montreux noted that there is outdoor storage and junk on adjacent <br />properties, not just this one. The City Administrator noted that Buck <br />Blacktop is across the railroad from this property, and while there are uses <br />that are grandfathered, there are also some outdoor storage issues that need <br />to be cleaned up. The Administrator pointed out some additional outdoor <br />storage problems on the properties to the south, and indicated that code <br />enforcement efforts are being made in the entire area. <br />Keis stated that it is difficult to determine the nature of Mr. Anderson's <br />hobby without him present to answer questions. Blesener noted that Mr. <br />Anderson's activities could be a second job and that he may be working <br />on cars for others. <br />Keis noted the Planning Commission's recommendation to allow the <br />interim use permit for one year or until the property is sold, whichever is <br />sooner. Keis asked if this was a sufficient time period. Montreux stated <br />that it was provided that the interim use permit could be renewed. Keis <br />felt that there should be an end date to the permit. <br />Blesener suggested that rather than issue an interim use permit, that the <br />City give Mr. Anderson six months to cleanup the property an find <br />another location. Montreux noted that there are high property taxes on <br />this property, and renting to Mr. Anderson generates a little bit of income. <br />It also ensures that someone is on the property rather than having it sit <br />296 <br />
