Star Associates Limited Partnership, a Minnesota limited partnership is the owner of <br />the North Star Estates. They have owned the Property since 1996 and throughout their ownership <br />and prior to their ownership, the Property accessed Country Drive, a public road, via two access <br />driveways over Lot E, which property is owned by the City and which you indicated was not a public <br />access area. <br />Our client is in the process of refinancing the Property and our Lender is requiring a more <br />definitive document to memorialize the access to Country Drive, other than via a prescriptive <br />easement. Accordingly, we have prepared for your consideration an Access Easement Agreement, a <br />copy of which is attached to this email. Our Lender has approved the Agreement and the Title <br />Company has approved it also. <br />It is our hope that you can present this to City Council tonight for consideration and for <br />execution by the appropriate person at that time or as soon as possible. We realize that this <br />Agreement must be reviewed by the City Attorney. That being said, if you or they have any <br />questions, please do not hesitate to contact me immediately. <br />1 am also attaching to this email, the most current Survey that we received this morning along <br />with a copy of the current Title Commitment. <br />Our Lender is waiting for a status as to your approval of this and any comments from the City <br />Attorney.
