MINUTES <br />PLANNING COMMISSION <br />FEBRUARY 13, 1997 <br />Anything over 1,000 square feet would require a <br />Conditional Use Permit. However, the maximum accessory <br />and garage space for a single- family lot is limited to <br />1,500 square feet. <br />The Planner further reported that the ordinance limits <br />the placement of sheds and accessory buildings to rear <br />yards. The ordinance does provide a conditional use <br />process for placement of these structures in side <br />yards. That process establishes architectural <br />standards which must be met. <br />It was noted that the Building Inspector has raised the <br />issue of air - conditioning equipment in required side <br />yards. Current code prohibits air - conditioning <br />equipment in the required side yard. The Building <br />Inspector has noted, however, that there are a number <br />of violations of this provision. <br />The Commission discussed options of limiting air - <br />conditioning equipment to rear yards or changing the <br />side yard setback for such equipment to five feet. <br />Issues such as odd - shaped lots or topography may <br />prohibit the installation of air - conditioning units in <br />back yards. Issues of neighbor's bedroom windows <br />adjacent to air - conditioning units in side yards was <br />also discussed. <br />The Commission decided to deal with the shed issue <br />separately from that of air - conditioning equipment. <br />The Commission expressed support for the shed <br />ordinance. <br />Carson recommended adoption of the shed /accessory <br />building ordinance as submitted. <br />Motion seconded by DeLonais. <br />Motion carried 4 - 0. <br />The Commission discussed various options for placement <br />of air - conditioning units, noting that there are many <br />factors to consider. These include house design, <br />topography and shape of the lot, design of adjacent <br />house, etc. DeLonais stated that from a noise <br />standpoint, the best place for an air - conditioning unit <br />would be in the back yard. A back yard location should <br />not have a noise impact on adjacent neighbors. <br />3 <br />Page 17 <br />
