MINUTES <br />PLANNING COMMISSION <br />FEBRUARY 13, 1997 <br />Knudsen pointed out that there is no solution which <br />works for everyone. Currently there is no enforcement <br />of the ordinance, therefore, air conditioning units are <br />being placed at will. <br />Carson suggested that the current Code be left as is. <br />If the issue is a problem to residents in the City, <br />then it should be addressed. Knudsen agreed and <br />suggested that the Inspection Department be instructed <br />to begin enforcing the existing Code for all new air - <br />conditioning units. The Commission agreed. <br />TOWER The Commission reviewed the proposed tower ordinance. <br />ORDINANCE Carson pointed out that the ordinance does not regulate <br />satellite dishes 3 feet in size or smaller. The <br />Planner replied that that was correct. The Planner <br />reported that the larger satellite dishes are subject <br />to accessory equipment setbacks. These dishes must be <br />placed in the rear yard unless it is functionally <br />impossible to locate in the rear yard. This is an FCC <br />regulation. The Planner indicated that the reality of <br />the situation is that most people will be able to <br />locate a satellite dish in the rear yard or on the roof <br />of their home. <br />The Planner explained that the ordinance requires <br />towers up to 120 feet in height to have the ability to <br />support two antennas, and towers over 120 feet in <br />height to support three antennas. The Planner stated <br />that initial discussion was that co- located antennas <br />would require an administrative permit. The ordinance <br />provides co- locations by Conditional Use Permit. <br />It was the consensus of the Commission that co- <br />locations should be by administrative permit rather <br />than conditional use permit. <br />Mr. Barraclough recommended approval of the proposed <br />tower ordinance as submitted with the amendment <br />allowing co- located antennas by administrative permit. <br />Motion seconded by Keis. <br />Motion carried 4 - 0. <br />4 <br />Page 18 <br />
