simplified. <br />• 1301.040 - Water Skiing - Because of the 150 foot slow - no wake zone along the <br />shoreline, you can eliminate most of this section. The exemption for water skiers using a <br />direct route to and from open water can be covered in the Slow - No Wake section. <br />Since the sheriff has been given the authority to issue permits by law, the Attorney <br />General's Office has informed us that a local unit of government may not require a permit <br />beyond the one issued by the county. The Ramsey County Sheriff's Department, however, <br />has a policy of clearing any event permits for structures (other than swim rafts or mooring <br />buoys) through the affected municipalities. <br />® 1301.050 - Motorboat Racing - See the comment in the previous section on permits. <br />® 1301.060 - Submersible Vehicles - Unless you are having a problem with these, (and we <br />haven't anywhere else in the state), you don't include them in this ordinance proposal. <br />1301.070 - Lake Gervais Restrictions duri g High Water - This section can be <br />simplified, and covered in the Slow - No Wake section. The exemption for enforcement <br />personnel should cover the whole ordinance, not just during high water. <br />® 1301.070 - Winter Use - This whole section can be simplified. Noise requirements <br />cannot be changed to match motorboats. There are already state laws or rules regulating <br />the noise limits for cars, trucks, snowmobiles, ATVs etc. There is also a state law <br />regarding removal of litter from the ice surface. It would be difficult for a motor vehicle to <br />travel at "slow - no wake" speed. It might be a good idea to use 10 or 15 MPH. <br />ar <br />1,10, - Regulation of Aircraft - Seaplanes are regulated by the Minnesota Department <br />of Transportation, Aeronautics Division. There are only 5 lakes in Ramsey County which <br />allow aircraft, and none of them are in Little Canada. This ordinance is not needed. <br />You need to add a section regarding exemption of enforcement personnel. The <br />Notification and Effective Date sections are also missing. They should be added to the <br />ordinance. <br />Hopefully, these suggestions should clarify your proposal and bring it in line with our <br />rules. I have enclosed a copy of a suggested ordinance language. Please remember that this letter <br />is not the formal approval required by law.
