Fahey <br />COUNCIL <br />Beverly Scaize <br />Jim LaValle <br />Steve Morelan <br />Bob Pedersen <br />ADMINISTRATOR <br />Joel R Hanson <br />At the Council's February 12th meeting, Chapter 1301 of the <br />Municipal Code was amended with regard to surface water <br />regulations for Gervais Lake. The result of that action is that <br />the City's surface water regulations apply only to Gervais Lake <br />and the regulations which existed for all lakes in the City were <br />deleted. <br />As you know, Minnesota <br />regulations, and these <br />within Little Canada. <br />State Statute if it so <br />Statutes contain surface water <br />apply to all lakes and bodies of water <br />The City can be more restrictive than <br />chooses. <br />After reviewing State Statutes, it appears that the result of the <br />deletion of other bodies of water from the City's regulations is <br />that the no wake zone which the City had of 300 feet no longer <br />exists, and the State's no wake zone of 100 feet would apply. <br />(Please note that the City's ordinance for Lake Gervais provides <br />for a 150 foot no wake zone.) If the Council is comfortable with <br />this, no further action is needed. If not, another ordinance <br />will be needed to create regulations for other bodies of water. <br />Page 60 <br />
