AND <br />That part of Minnesota Avenue (now vacated) as shown on said <br />plat of J.F. Eisenmenger's Garden Lots lying easterly of the <br />northerly extension of said west line of Lot 42 and lying <br />westerly of said line drawn 60.00 feet northwesterly of and <br />parallel with Line 2 described above. <br />AND WHEREAS, <br />A public hearing was held on the 12th day of March, 1997 before <br />the City Council in the City Hall after due published and posted <br />notice had been given by the City Administrator, a reasonable <br />attempt was made to give personal notice to all affected property <br />owners, and all persons interested were given an opportunity to <br />be heard; <br />AND WHEREAS, <br />Any person, corporation or city owning or controlling easements <br />contained upon the property vacated, reserves the right to <br />continue maintaining the same or to enter upon such way or <br />portion thereof vacated to maintain, repair, replace, remove or <br />otherwise attend thereto; <br />AND WHEREAS, <br />It appears that it will be in the best interest of the city to <br />vacate such road right -of -way easement; <br />AND WHEREAS, <br />Four- fifths of all members of the City Council concur in this <br />resolution; <br />NOW, THEREFORE, BE IT RESOLVED, that the above - described road <br />right -of -way is hereby vacated. <br />Adopted by the Council this 12th day of March, 1997. <br />Attest: <br />Approved: <br />Michael I.
