MAR-12-1997 13:46 SBA, INC. <br />Memo to James Willis <br />Page 2 <br />8301924 P.12'12 <br />The Council was concerned that there is a conflict with subdivisions 2 and 6. <br />' Subdivision 2 regulates in which districts. towers are allowed, while subdivisions <br />6 & 7 discuss' heights .of towers and their required setbacks from residential <br />zones. Subdivision 6 is not in conflict with subdivision 2 since it talks about <br />setbacks of towers on non residential property from residential properties. <br />Subdivision 7 has been clarified with additional language. Subdivision 7 <br />regulates height of towers which are allowed as exceptions,. i.e. residential TV <br />antennas, ammeter radio towers (ham radio), etc. <br />The City Attorney reviewed subdivision 11 regarding obsolete towers and t <br />specifically the letter of credit required to cover the cost of removal of the tower. <br />A letter of credit requires yearly renewals which puts an unnecessary financial <br />burden on the applicant and is difficult for staff to monitor and administer. Since <br />there is adequate means in the Code currently addressing removal of abandoned <br />buildings, the City Attorney recommends that this Ianguage be stricken from the <br />draft ordinance_ The draft ordinance presented has been amended to remove <br />this Ianguage. <br />4. CONCLUSIONS AND RECOMMENDATIONS: <br />Planning Division.
