515 Little Canada Road, Little Canada, MN 55117 -1600
(612) 484 -2177 / FAX: (612) 484 -4538
March 11, 1997
Mr. John Shamp
Donovan Construction, Inc.
53 S. Owasso Blvd.
Little Canada, MN 55117
Re: Temporary Office Building
Request for One Year Extension for Conditional Use Permit
Dear Mr. Shamp:
MAYOR
Michael I. Fahey
COUNCIL
Beverly Scalze
Jim LaValle
Steve Morelan
Bob Pedersen
ADMINISTRATOR
Joel R. Hanson
As you know, at the time Donovan Construction made application for a Conditional Use
Permit for a temporary office building at 53 S. Owasso Blvd., it was represented to the
City that it was the parent company's intention to start construction of an estimated 2,400
square foot permanent office building at 53 S. Owasso Blvd. within one year of obtaining
clear title to the property. It was because of the title problem that the temporary office
building was necessary.
In my letter to you dated March 7, 1997 it was pointed out that the Conditional Use
Permit approved by the Council on December 20, 1995 was for a period of one -year.
That Permit has now lapsed, and it is necessary that the temporary office building either
be removed or Donovan Construction apply for an extension of the CUP. In acting on
the CUP application in December of 1995, the Council discussed the fact that they
supported the temporary office building at that time in order to give the applicant an
opportunity to clear up title problems on the property. However, the Council was not
interested in seeing the temporary office building remain on the property long -term.
Therefore, in addition to your note requesting extension of the CUP for a period of one
year, I would like to further request that you report on the status of title problem for this
site, and submit a long -term plan for removal of the temporary office and replacement
with a permanent office building. Without this information, City staff will be unable to
recommend in favor of the Conditional Use Permit extension you have requested. It is
staff's plan to schedule discussion of this matter at the March 26, 1997 Council meeting.
Page 13
