MINUTES <br />CITY COUNCIL <br />DECEMBER 20, 1995 <br />TO PERMIT <br />TEMPORARY <br />OFFICE <br />UNTIL <br />PERMANENT <br />OFFICE <br />IS <br />CONSTRUCTED - <br />DONOVAN <br />CONSTRUCTION <br />application submitted by Donovan Construction for a <br />Conditional Use Permit for a Planned Unit Development <br />to permit a temporary office building until a <br />permanent office building is constructed on property <br />located at 53 S. Owasso Blvd. Fahey noted that both <br />the Planning Commission and City Planner have <br />recommended approval subject to compliance with the <br />recommendations of the City Planner as contained in <br />his report dated December 8, 1995. Fahey asked if <br />there was anyone from the general public present <br />wishing to comment on this application. There was not. <br />Upon motion by Morelan, seconded by LaVaile, the public <br />hearing was closed. <br />Morelan asked if the temporary office building was a <br />trailer -type structure. <br />Ann Pieper, Pieper Companies, replied that the <br />temporary office would be two modular structures <br />combined with a common roof line. Pieper indicated <br />that the structure would be a professional - looking <br />business. <br />The City Planner stated that he wished to clarify his <br />recommendation in that the duration of time the <br />temporary structure can exist should be addressed in <br />the development agreement as a one -year period. If <br />after one year the developer is not able to construct a <br />permanent structure, an extension would have to be <br />requested to allow the temporary office to continue to <br />exist on the property. <br />Fahey noted that the City wants to avoid the situation <br />were a property owner comes back year after year <br />requesting an extension, and the mobilehome stays on <br />the property long -term. <br />The Planner stated that his recommendation is that the <br />permit for the mobilehome not be open- ended, but for a <br />one year duration. <br />Fahey asked if that was clear to the applicant. <br />Pieper reported that clear title to the property must <br />be obtained before the permanent building is <br />constructed. Clear title will also provide exact <br />definition of where the lot lines are. Pieper stated <br />that within one year of obtaining clear title on the <br />property, the permanent office building will be <br />constructed. <br />Page 3 <br />
