515 Little Canada Road, Little Canada, MN 55117 -1600
(612) 484 -2177 / FAX: (612) 484 -4538
MEMORANDUM
TO: Mayor Fahey & Members of the City Council
FROM: Joel R. Hanson, City Administrator
DATE: May 22, 1997
RE: Gervais Lake Ordinance Update
MAYOR
Michael I. Fahey
COUNCIL
Beverly Scalze
Jim LaValle
Steve Morelan
Bob Pedersen
ADMIN151 BATOR
Joel R. Hanson
At the last Council meeting, I was directed to contact the Sheriff's Department regarding the
level of enforcement one could expect relative to the launching of canoes from the County
property adjacent to Gervais Beach. In talking with Lieutenant Jerry Bergeron of the Water
Patrol Division of the Ramsey County Sheriff's Department, he informed me that County
ordinances also prohibit launching of water craft from this area. He did state that should the
Sheriff's Department observe a canoe being launched in this area, they would be obligated to
inform that person of the ordinance provisions and ask that they go to Spoon Lake. He also
pointed out that given the demands placed on the Water Patrol for enforcement on a County-
wide basis, he does not think this would be the type of violation they would be aggressively
attacking. In fact, he was unaware this activity was occurring.
Attached is a letter received from Mark Weavers relative to this subject. He seems to concur
with our earlier discussion whereby canoes can be prohibited if a problem situation arises. That
condition has not existed to -date. It should also be noted that the old ordinance had a similar
restriction.
Therefore, it is my recommendation we not make any changes to the ordinance as adopted. The
launching of canoes seems to be an insignificant event that has not been addressed in the past
and therefore is not likely to be in the future unless abusive situations arise.
JRH:kpv
Enclosures
cc: Mark Weavers, Gervais Lake Association
Dennis Carson
page 156
