arise out of any use of the premises by Licensee. <br />11. As part of the consideration for this agreement, Licensee <br />expressly waives all right, claim or cause of action which Licensee, <br />its heirs, representatives and assigns, may now or hereafter have <br />against NS ?, its successors or assigns, occasioned by or arising <br />from any interference with radio, television, or other communication <br />transmission or reception in or upon any portion of the premises <br />described in paragraph 1 hereof, caused or occasioned in any manner <br />by the presence, or operation of electric transmission lines and <br />related facilities in and upon the above described easement crossing <br />a portion of said premises. <br />12. If, for any reason, the Licensee shall not keep and per- <br />form any and all of the covenants and agreements contained herein, <br />and should the Licensee fail to correct the condition violated <br />within 60 days after receiving written notice to do so from NSP, <br />the License graisted herein shall thereafter automatically terminate <br />without further act by NSP and the Licensee shall surrender the <br />above premises to NSP in substantially their original condition. <br />13. Should any mortgagee or any mortgage or the beneficiary <br />of any deed of Trust covering or affecting said above described <br />parcels furnish NSP with a duplicate original or certified copy <br />of the instrument encumbering said parcels, then so long as such <br />encumbrance shall continue in force, NSP shall thereafter mail <br />by registered or certified mail to such mortgagee or beneficiary <br />at the same time as such notice is given to the Licensee, a.dupli <br />cate copy of any notice of default which NSP may from time to time <br />serve upon Licensee pursuant to the provisions of this agreement. <br />Page 94 <br />
