The purpose of the proposed garage is stated above. Again, the subject site is isolated <br />at the end of a cul -de -sac and the proposed structure will not be located near any <br />developable property. Thus, the proposed accessory building area in excess of 1,000 sq. <br />ft. is not anticipated to present any negative impacts. <br />Proposed design and materials. The applicant has not indicated the design or materials <br />to be utilized in the construction of the proposed garage. The proposed garage should be <br />designed in a manner consistent with the existing single family house and be constructed <br />of similar materials and colors. <br />Height. The applicant has not indicated the height of the proposed detached garage. <br />Section 903.020.D.3 of the Zoning Ordinance limits the height of accessory structures to <br />15 feet. <br />RECOMMENDATION <br />The granting of variances is a policy issues best decided by City Officials. If the City is <br />inclined to grant this variance request, it will be important that the approval is based upon <br />the unique features of the property described herein and not related to the needs of the <br />residents. This is necessary to distinguish this request from potential future applications <br />for similar variances that may not be justified due to a lack of special conditions that are <br />property specific. As such, an approval of this variance should be based on findings <br />similar to the following: <br />The subject site is unique as it is the only dwelling located the cul -de -sac which it <br />fronts. <br />• There is no possibility of development on any other parcel which fronts the cul -de- <br />sac due to exceptional wetland conditions. <br />• There will be no other access to the cul -de -sac from other properties fronting the <br />cul -de -sac due to exceptional wetland conditions. <br />• The installation of a second curb access on the subject property to the cul -de -sac <br />will not create any negative impacts related to traffic, street maintenance or snow <br />storage. <br />Should the City choose to grant the applicant's variance request, our office would <br />recommend approval of a CUP to allow a second garage for a single family use and a CUP <br />to allow accessory building area of 1,104 sq. ft. for a single family use, subject to the <br />following conditions: <br />Page 36 <br />
