Existing Sign. The existing 40 foot tall sign (measured from grade) is mounted on the <br />roof of the structure, which is approximately 15 feet high. Roof signs are no longer <br />allowed by the Zoning Ordinance. In 1987, the applicant requested and was granted a <br />variance to allow for a 40 foot tall free standing sign, as measured from floor grade. The <br />justification for the variance was the natural topographic features discussed above that <br />prevent views of the building from 1-694. The existing sign was approved with a maximum <br />elevation of 926.5 feet. <br />Variance request. The applicant is proposing to construct a 40 foot tall free standing <br />pylon sign. Section 903.110.E.5.C(3) of the Zoning Ordinance allows for a maximum <br />height of 25 feet. Given that the existing sign for which the 1987 variance was granted is <br />being removed and replaced with a new free standing pylon sign, the applicant has <br />requested a new variance to allow the proposed sign to be 40 feet high, the same height <br />as the existing sign when measured from floor grade. <br />Variances are intended to provide relief from the literal interpretation of the Ordinance in <br />instances where their strict application would cause undue hardship to the property in <br />question, based upon unique conditions, and when such variances are in keeping with the <br />intent and purpose of the Zoning Ordinance. Special conditions may include topographic <br />conditions such as the significant elevation change that blocks views of the site from 1-694. <br />Based upon the existing topographic features of the site and the past precedence for <br />granting a variance on this basis, the applicant's current variance request for a 40 foot high <br />free standing pylon sign is reasonable. <br />Size of proposed sign. The applicant has not submitted detailed plans for the proposed <br />sign. Based upon the requirements outlined in Section 903.110.E.5.C(3) of the Zoning <br />Ordinance and the size of the existing building, the proposed sign cannot exceed 180 <br />square feet. <br />Location of proposed sign. The scale of the site plan submitted by the applicant is such <br />that the actual location of the proposed sign cannot be verified. The proposed sign will be <br />required to be setback a minimum of five (5) feet from the property line. In addition, the <br />proposed sign may not be located in any required parking stalls. <br />Sign licence. The applicant will be required to obtain a sign licence and pay all applicable <br />fees prior to construction of the proposed sign. <br />Page 5 <br />
